PROMOTION DETAILS

Enter to Win a ShowBox in the Show-Rite ShowBox Giveaway. Contest begins on October 25, 2019 and runs through November 8, 2019. Entries must be received by the end of business on November 8, 2019. Must be 18 years or older and a legal resident of the continental United States to enter to win.  Exact chances of winning are determined by the total number of entries received.  Approximate retail value of prize is $550.  There is no maximum number of entries but only one entry per person.

 

To enter on Facebook:  LIKE the Show-Rite page (if you haven’t already) then Like or Share the Contest announcement and tag three friends.

 

To enter on Instagram:  Follow the Show-Rite page (if you haven’t already) then post and tag three friends in the comments.

The winner will be randomly drawn from all entrants on November 9, 2019.

 

 

Employees of Alltech, Inc. and affiliated companies, or employees of Alltech Inc.’s marketing or advertising company, residents at the same address as any such employee or dependents of any such employee are not eligible to enter and win. No substitution, transfer, or cash equivalent for prizes.  Alltech, Inc. may at its sole and absolute discretion substitute a prize of equal value due to prize unavailability for any reason or for circumstances beyond its control. Winner will be randomly selected.  Winner will be required to sign a Declaration of Eligibility and Authorization to use his/her name and photograph for promotional purposes without further compensation and a Release of Liability and Indemnity Agreement.  Federal and state laws and regulations apply.  All taxes (including income taxes), fees and charges relating to the use and acceptance of the prize are the sole responsibility of Winner.  Failure to comply with any requirement shall constitute forfeiture of the prize.  If the selected winner forfeits the prize, a substitute winner may be selected in the absolute discretion of Alltech, Inc.  Alltech Inc.’s decisions on eligibility and awarding of prize(s) are final and binding. Any depiction of prizes is for illustrative purposes only.

 

INDEMNIFICATION AND LIMITATION OF LIABILITY

 

BY ENTERING THE CONTEST, EACH PARTICIPANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS ALLTECH, INC.  AND ITS AFFILIATE AND SUBSIDIARY COMPANIES,  ADMINISTRATOR, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT PARTICIPANT’S PARTICIPATION IN THE GIVEAWAY AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. ALLTECH AND ITS AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. ALLTECH, INC. AND ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.

 

USE OF PERSONAL INFORMATION: The collection of personal information for the Contest will be governed by Alltech’s Privacy Policy, http://www.alltech.com/privacy-policy.

 

 

GOVERNING LAW

These Official Rules shall be governed by the laws of the State of Kentucky without regard to conflict of laws principles and any actions, claims or suits shall be held in a federal or state court located in the State of Kentucky.

BY PARTICIPATING IN CONTEST:

 

  1. I represent that am at least eighteen years of age, eligible to participate in this Contest and eligible to  receive the Prize awarded to me.  I represent that I satisfy all eligibility requirements set forth herein, which I acknowledge having read and understood, and any other requirements imposed by law.

 

  1. I agree to indemnify, release and hold harmless the Sponsor, and its related companies, subsidiaries, affiliates, administrator, advertising and promotional agencies, and all of its respective owners(s), officers, directors, employees, contractors and agents (the “Released Parties”) from and against any liability, damage, losses, injury, or claim or cause of action arising out of the creation, administration, fulfillment, or participation in the Contest receipt or use or misuse of any Prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors related to mobile device(s), computers, servers, providers, telephone or network lines, or any interrupted or unavailable network server or other connections or communications; (c) any errors, omissions, interruptions or deletions of any kind due to electronic, human, mechanical, printing, production or technical errors or other causes; (d) errors in the administration of the Contest or the processing of entries; (e) injury, death or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from such entrant’s participation in the Contest or receipt or use or misuse of the Prize; (f) any damage to any computer system resulting from access to or the download of information or materials connected with the Contest; (g) any errors for inability to correctly read or interpret Entrant’s writing on an entry form; (h) inability to make contact with Winner. I waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

  1. I accept the Prize at my sole risk and take absolute responsibility for any injuries incurred out of use of the Prize, including, without limitation, the risk of personal injury and/or death, and WILL NOT HOLD SPONSOR OR ANY OTHER RELEASED PARTIES RESPONSIBLE.

 

  1. I acknowledge that all federal, state, and local taxes (including income taxes), fees and charges relating to the use and acceptance of the Prize are the sole responsibility of me.

 

  1. I acknowledge that the Sponsor and its subsidiary, sister, affiliate and related companies do not make any warranties, express or implied, as to the condition, fitness or merchantability of the Prize.

 

  1. I agree that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a Commonwealth of Kentucky state or federal court. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, this Affidavit and Release, Potential Winner’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Kentucky, without giving effect to any choice of law or conflict of law rules that would result in the application of the laws of any jurisdiction other than the Commonwealth of Kentucky.

 

  1. Unless prohibited by law, I hereby grant Released Parties permission and consent to irrevocably and in perpetuity, without additional compensation to me, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, display, and perform, worldwide, my name, image, visual likeness, and biographical data, in whole or in part, in print or electronic format or any form of media, now known or hereafter developed in connection with the promotional or business activities of Sponsor.

 

  1. Neither am I, nor is any immediate family member (defined as parents, siblings, spouse and children) or person residing in the same household, an employee, officer, or director of Alltech Inc., or any of its subsidiary, sister, affiliate, or related companies.

 

  1. I agree that this Affidavit and Release shall apply to and be binding on me and my heirs, executors, administrators, personal representatives, successors and assigns.

 

  1. I agree that if any portion of the Affidavit and Release is invalid, the remainder will continue in full force and effect.

 

  1. DISCLAIMERS OF WARRANTY: Sponsor and its affiliate and subsidiary companies do not make any warranties, express or implied, as to the condition, fitness or merchantability of the prize(s).

 

 

  • GENERAL TERMS AND CONDITIONS: The Sponsor reserves the right to withdraw, amend or suspend this Contest (or to amend these Official Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Official Rules, including, without limitation, any error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud or technical failure. The Sponsor reserves the right to cancel, amend or suspend this Contest, or to amend these Official Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.

 

The Sponsor reserves the right to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Official Rules, to the extent necessary, for purposes of verifying compliance by any entrant with these Official Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Official Rules, or for any other reason.

 

In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest-related materials, the terms and conditions of these Official Rules shall prevail, govern and control to the fullest extent permitted by law.

 

  • DISPUTES: Except where prohibited, each Entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a Commonwealth of Kentucky state or federal court.   • SEVERABILITY: The unenforceability of any clause of the Official Rules will not impact the enforceability of all other provisions of the Official Rules.
